At the end of 2024, the Hungarian Government adopted Government Decree 450/2024 (XII. 23.), introducing amendments to the regulation of residence permits for employment purposes. The new provisions came into effect on January 1, 2025, primarily affecting third-country nationals who wish to work in Hungary in low-skilled occupations.

The amendment imposes significant restrictions, as under the new law, most third-country nationals are no longer eligible for a residence permit for employment purposes. It is important to emphasize that this type of permit is not the same as the guest worker residence permit, which is subject to different regulations.

Conditions for Obtaining a Residence Permit for Employment Purposes

The amendment establishes two possible ways for third-country nationals to become eligible for a residence permit for employment purposes in Hungary:

  1. Based on a readmission agreement
    Third-country nationals whose home country has signed a readmission agreement with Hungary or the European Union may be granted this type of permit. The countries covered by such agreements are listed in Annex 1 of the government decree, which currently includes Georgia and Armenia.
  2. With the guarantee of a state-recognized organization or office
    Third-country nationals may also qualify if their home country has a state-recognized organization or office in Hungary that assumes responsibility for ensuring their compliance with Hungarian and EU immigration laws. This includes ensuring that, in case of non-compliance, the individual leaves Hungary and returns to their home country. The list of eligible countries is outlined in Ministerial Notice 2/2025 (I. 9.) of the Minister of Foreign Affairs and Trade. At present, only the Republic of the Philippines is included on this list.
